These Terms govern your use of the FlorAI – AI Garden Design app, the FlorAI Web App and the FlorAI website. Please read them before using the Services.

1. About these terms

These Terms of Service (“Terms”) govern your use of the FlorAI – AI Garden Design app, the FlorAI Web App and the website at https://www.gardendesigns.app (together, the “Services”). The Services are provided by Rocket Digital Limited (“FlorAI”, “we”, “us”). By using the Services, you agree to these Terms.

2. Eligibility

You must be at least 13 years old to use FlorAI. If you are using FlorAI on behalf of a household or organization, you confirm that you have the right to do so.

3. Your account

You are responsible for keeping your account credentials safe and for activity under your account. Please tell us immediately if you suspect unauthorized access.

4. Subscriptions and billing

Some FlorAI features require a paid subscription. Subscriptions are managed through RevenueCat together with the Apple App Store or Google Play. Pricing, billing cycles and renewal terms are shown at the point of purchase. Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period. You can manage subscriptions in your App Store or Google Play account.

5. Refunds

Refunds are handled by Apple and Google according to their respective policies. We do our best to support you when problems arise.

6. AI features and how to use the results

FlorAI generates AI garden design ideas, plant identifications, plant health suggestions and other AI-assisted content using providers including OpenAI, Microsoft Azure, Replicate and Fal.ai. AI results are provided for visual inspiration and early-stage planning. You should:

Treat AI garden design and AI landscape design ideas as inspiration, not engineering plans.
Talk to a qualified professional for construction, drainage, irrigation, grading, permits or other complex landscaping work.

7. Content you upload

You retain ownership of the photos you upload. By uploading content to FlorAI you grant us a non-exclusive, worldwide license to process, store and transmit that content as reasonably needed to provide the Services and improve them. You confirm that you have the right to upload the content and that it does not infringe anyone’s rights.

8. Acceptable use

When using FlorAI you agree not to:

Upload illegal, harmful, abusive, obscene or misleading content.
Upload photos of identifiable people without their consent.
Use the Services to infringe intellectual property or privacy rights.
Reverse engineer, scrape, abuse rate limits or attempt to disrupt the Services.
Use the Services to build a competing product or train competing AI models.

9. Intellectual property

The FlorAI brand, app, website, designs, logos and original content are owned by Rocket Digital Limited and protected by intellectual property laws. The AI-generated outputs you create from your own photos are yours to use for personal and non-commercial garden planning purposes. For other uses, please contact us.

10. Disclaimers

FlorAI is provided “as is” and “as available”. We do not guarantee that AI garden design ideas will be free of errors, suit your specific site, comply with local regulations or produce a particular outcome in real life. The Services are not a substitute for professional landscape architecture, horticultural, structural or legal advice.

11. Limitation of liability

To the maximum extent permitted by law, Rocket Digital Limited will not be liable for indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenues or data, arising from your use of FlorAI. Our total liability for any claim arising out of or relating to the Services will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) USD 50.

12. Termination

You can stop using the Services at any time. We may suspend or terminate accounts that violate these Terms or that put the Services at risk. Sections that by their nature should survive termination will survive.

13. Changes

We may update these Terms from time to time. The latest version will be posted at https://www.gardendesigns.app/terms with the effective date below. Continued use of the Services after changes means you accept the updated Terms.

14. Governing law

These Terms are governed by the laws of Hong Kong SAR, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of Hong Kong SAR, except where mandatory consumer protection laws apply.
